Is Abortion A Synonym For Homicide - 1126 Words

Abortion, a Synonym for Homicide Abortion is inhumane, slavery was legal 150 years ago however, just because something is legal does not necessarily make it appropriate especially with various other alternatives available Insurance companies do not cover the cost of any other crime that an individual commits such as, burglary, forgery or arson, why should they cover homicide? From the point of conception the embryo has a soul, and is growing into a human. The fifth week of pregnancy, or the third week after conception, the baby s brain, spinal cord, heart and other organs begin to form. Having intercourse resulting in an unwanted pregnancy is like touching a hot stove knowing the end result and getti ng scalded then wanting another individual to pay for your mistake in touching the hot burner. Intercourse is designed for a mature man and woman who love each other as 1 Corinthians 7 reads, â€Å"Now concerning the matters about which you wrote: â€Å"It is good for a man not to have sexual relations with a woman.† 2 But because of the temptation to sexual immorality, each man should have his own wife and each woman her own husband. 3 The husband should give to his wife her conjugal rights, and likewise the wife to her husband. 4 For the wife does not have authority over her own body, but the husband does. Likewise the husband does not have authority over his own body, but the wife does. 5 Do not deprive one another, except perhaps by agreement for a limited time, that you may devote yourselves to prayer; but then come together again, so that Satan may not tempt you because of your lack of self-control.† (English Standard Version, 1 Corinthians 7: 1-5.). How Social Midea Impact on Hospitality Industry in China Market Research Proposal

Essays on How Social Midea Impact on Hospitality Industry in China Market Research Proposal The paper "How Social Midea Impact on Hospitality Industry in China Market" is an excellent example of a research proposal on marketing. The hospitality industry, particularly hotels, uses a number of social media platforms like Facebook, YouTube, LinkedIn, and Twitter to market its services and products. Social media, through a vast array of its technologies, enable this industry to monitor perspectives and facilitate online functionality through data and other tools to either develop or further enhance the quality and reach of its services with an aim to drive customer satisfaction. Social media as a potent marketing tool helps engage customers in a dialogue and recognize their expectations.Whereas previously hospitality industry was able to interact with its customers during the period in which services were provided, now social media has made it possible to do the same during, before and even after the customers avail hospitality services. The use of social media in the hospitali ty industry is gradually getting viral and the technology is not only new but also offers an unmatched advantage on account of being affordable with a reach that is unimaginable.Lanz, Fischhof, Lee (2010) have stated that platforms like YouTube, Twitter, Facebook, and LinkedIn provide exceptional access to guests. They do not only enable the industry to be in direct touch with the customers and seek direct feedback in a matter of a few minutes but also increases brand awareness of the products available. Better the understanding of the hospitality industry of social media, greater are the chances of staying afloat in a highly competitive scenario. Hotels are the main stakeholders in the hospitality industry and the correct mix of marketing forms the main aspect of its growth and success. As on date, social media is considered to be a 'new marketing kid in town' which, if used appropriately, can provide niche entry points in this competitive world’s marketplace. It is imperati ve for managers working in the hospitality industry to continuously look for tools that appeal to new customers and retain old ones (Schneider, 2009). In today's marketplace that is driven by ‘virtual world networks’, social media plays an important role. Laudon and Traver (2007) have remarked that groups of individuals or businesses that have a profile created for them either to communicate with each other or promote themselves give rise to social networks.Social media in China provides interesting statistics. Nearly 30 percent of social media users are in the age group of 26 to 20 years, a target considered as ideal for advertisers. On a whole nearly as many as 91 percent of the Chinese population using the internet has social accounts; a figure that is around 22 percent more than that of the United States. China's top 10 social media sites are inhabited by an estimated 3.2 billion individual accounts with nearly 507 million people active on social media (Millward, 20 13).

Boundaryless Chains of Organizational Structure †MyAssignmenthelp

Question: Discuss about the Boundaryless Chains of Organizational Structure. Answer: Introduction The report focuses on the ways in which job and enterprises have changed over the last 10 years. This study provides an overview about how these changes have influenced the job of manager in todays world. In context to this, the skills that a manager requires to be successful are also discussed in this study. Change in enterprises has lead to change in management of the enterprises and the job of managers. At present times, the managers play crucial role in the management of the enterprises. For the last 10 years, the role of mangers in managing the enterprise has changed. Now- days, the mangers play three basic roles- interpersonal, informational and decisional. Moreover, the functions performed by the managers during these years involves planning, organizing, controlling, staffing and leading (Dozier, Grunig and Grunig 2013). As the managers are present in all aspects of management, change in their job helps them to achieve target of business. The role played by the managers of todays enterprises basically involves effective decision making. The mangers of companies have four roles involving- entrepreneurial, resource allocator, conflict handler and negotiator under which it requires their decision making skills. As an entrepreneur, the mangers make decision regarding initiation of improvement project and identification of new ideas. As resource allocator, they decide the resources to be allocated and budget to be prepared (Pettigrew 2014). In fact, they also take proper decision on the action to be implemented for resolving any conflicts. Furthermore, as negotiator they represents department while negotiations of sales, Union contracts, budgets etc. As conflict handler, the managers take proper action in response to unforeseen issues. The entrepreneurial role played by manager involves initiation and reviewing of new products, improve business operations, adapts to varying environmental factors etc. Planning refers to setting target and adopting methods for achieving them. The foundation of planning is to achieve target within a specified time. In the last ten years, the engagement of managers in planning has changed hugely. Managers now make business plans mainly because of four reasons, which includes- reducing influence of change, minimizing redundancy, providing strategic direction to employees, setting standards for facilitating control and so on. Now-a-days, managers make strategic planning not only to attain goals but also to attain competitive edge over their rivalries (Drucker 2012). Based on time frame and business objectives, mangers now make short term, middle term and long term plans. This strategy helps them to devise actions in effective way and achieve success in project. Apart from this, effective adoption of strategic plan helps the managers to face challenges and avoid risk in business. While developing plans, they should basically focus on level of environmen tal uncertainty and future commitments. As a result, this will help them to avoid conflicts with higher authority. Organizational Structure and Design The companys structure and design pertains to the way where the managers arrange all departments of companies. For instance, smaller organizations usually have flatter structure and design with fewer management levels. On the contrary, larger enterprises use taller structures with several management echelons and employees. Since the organizational structure as well as design has changed over the years, the role of mangers also changed. (Ashkenas et al. 2015). Now- a- days, the executives creates specific operational procedures so that they can effectively communicate with managers and higher authority. Most of the organizations marketing managers decentralize marketing for making fast decisions. Recent evidences reflect that the managers of software organizations have changed their structure and design in order to increase efficiency of employees. The role of HR (human resource) managers in the present years has been constantly evolving. Previously, the HR managers were limited to handling routine record and primary data work among the workers. But now they are exposed to diverse complexities of workforce, strategic management of enterprise targets and legal obligations (Cascio 2018). They manages human resource by providing them training, assigning particular functions and giving them proper professional as well as supportive environment. There are fewer enterprises that still have one person administering human resources. In fact, they also provide the human resource with huge benefits including, subsidized pensions, shorten work days, provide flexibility in work, good salary packages etc. This in turn helps the managers to manage their human resource (Rice 2013). Conclusion From the above study, it can be concluded that managers in present business world plays vital role in making change in the management. Over the last few years, the responsibility of managers increased owing to increased competition among workforce. They manages the employees work and improve their quality of work life (QWL). As a result, this positively impacts on the performance of the enterprise. Magnetic Levitation Essays - Magnetic Levitation, Maglev, Levitation

Magnetic Levitation Magnetic Levitation (Maglev or Magnetic Suspension) is the method when an object is suspended with no other support besides its own magnetic field. This technology can support and move objects or vehicles, providing support without contact or friction, allowing for a fast and quite operation. The magnetic pressure is used to counteract effects of the gravitational and any other accelerations. There are some cases the lifting force provided by magnetic levitation, there are mechanical support bearings that provide some stability. This term is known as Pseudo-Levitation. When considering MAGLEV Train it is also important to think about the environmental impact the transportation network will make not only to global warming it makes by carbon dioxide emissions, but also noise pollution and land take damage that the environment will also have. The carbon dioxide emission from a magnetic levitation train is significantly less than traditional high speed express trains, due to the lower energy that is produced. Also consider that MAGLEV Trains may convert people from using everyday vehicles such as cars due to the amount of pollution that is being put out by them. Another important factor is the noise pollution even though it does not impact the global climate in the way that carbon dioxide emissions has. It does effect the local environment and those who live there. It can have effect on the local animal life altering or completely destroy a local ecosystem. But MAGLEV Trains do not have noise problems from the friction between the trolley and pantograph and doesnt have any noise problems from the rolling friction. The only noise that comes from a MAGLEV Train is from the aerodynamics. The last impact from a MAGLEV Train would be the land take. Which a normal rail system requires 14 meters wide track and a four lane freeway requires 30 meters wide. To construct a dual guide way for a MAGLEV Train would only require 12 meters. Which the destruction of natural animal habitats would be cut down from what a normal rail system and a freeway would cause and a less environmental impact. The Magnetic Levitation Train is a great idea and the technology behind it will defiantly will help out the environment and better reliable transportation for people worldwide. But there are always some things that might prevent this technology from advancing. There has to be someone constantly monitoring the separation between the vehicle and the guide way due to the unstable nature of the electromagnetic attraction. The EDS (electrodynamic suspension) has a strong magnetic field and it would make it impossible for individuals with pacemakers to board and travel. The train will need wheels or tracks when the vehicle is stopped. But as of 2008 there is new technology that is being develop but at this time has no commercial or full scale prototype. RANDOMNESS

RANDOMNESS Nathan Bransford wrote recently about the randomness of bestsellers. In other words, there isnt some magical power that preordains the qualities of a story that breaks records and defies the odds. Sometimes a perfect storm just comes together. Like the mega waves he describes at sea, the ones that appear from nowhere and make a huge impression in that vast, monstrous water, they just happen and cant be fore casted. http://blog.nathanbransford.com/2012/06/randomness-of-bestsellers.html And yet, we keep trying to understand the process. Whats worse,in my opinion, and this is a BIG gripe with me, is that we also bash traditional publishers for producing books that do not do well. Thats talking out of both sides of our mouths. We try to think we can duplicate bestseller status, and really learn how to define the path to such a level, as if there was a manual somewhere. That logic should also mean that if we can predict great books, then we know enough to avoid a bad one. The deal is, people, is that we can only write our best.Publishers can only attempt to predict what will sell. eaders can only pretend to recognize a debut book as a bestseller. The fact is that nobody has mastered how to make a bestseller. There is no HOW TO WRITE A BESTSELLER FOR DUMMIES. Just spoke to someone this week who justified self-publishing Hes only trying to assuage his own conscience, the one thats attempting to rationalize into a hazy reality that he probably has no chance with traditional publishing. So he says theyve lost touch, can no longer produce quality material, thus leaving him no choice but to proceed with self-publishing since it has equal credibility. This is my reality . . . and my explanation of publishing: The more seasoned, experienced people who lay their eyes and hands on your manuscript, the better the book. Note, I did not say traditional or self-published. Multiple layers of review and decision making goes into traditional publishing. If you self-publish, make sure you put the same degree of attention into your manuscript as a traditional publishing house would put into it. Hire editors. Hire a cover designer. Hire a for matter. That is, unless you are experienced yourself. That doesnt mean read instructions and learn as you go. Sure, you CAN learn as you go, but do not go it alone. Youll never see the landmines, no matter how many blog posts you read about the business. This business isnt about randomness. Its about diligence and focus to detail. Nothing is fool-proof. Failure exists. Less than satisfactory happens. But your odds improve the more experience you put into your books development, writing, and promotion. Instead of trying to orchestrate a bestseller, just write your best. Then recognize what you should and should not do. Be daring in your writing. Be grounded in your publishing, no matter which route you take.

Most sites that provide audio content also have links to the software you need. Most audio content can be played using one of three audio players that are readily available for free: Windows Media Player, RealPlayer, and Apple QuickTime. The three are available for both recent versions of the Windows and Macintosh operating systems; the RealPlayer is also available for Linux. CASE STUDY tree Essay Example | Topics and Well Written Essays - 750 words - 1

CASE STUDY tree - Essay Example It will also help Joan overcome the exceptional situation she is put in. There are various vital points that Joan needs to establish in order to justify her decision to follow the recommendation made by one of her officers that the 16-year-old mentally retarded boy should be provided with a community based treatment. She has to prove all her arguments valid to the reporter and therefore the following points may be put across in justification of the decision. May go about finding fault with the decision taken and rearrange the entire policy in a way that an experienced and more efficient officer is given the responsibility of the entire activity regarding the matter wherein he plays a key role. Although all these are possibilities, the chief probation officer should take the most innovative and judicious steps to see the plans of Joan are carried forward and realized as such an action alone could help the specific case to be resolved. Therefore, he needs to act with extra maturity and consciousness. The recommendation made by the probation officer in relation to the specific case of the 16-year-old child may be criticized on various levels. However, when the facts about the specific case are considered, these criticisms prove to be without any room. There is no situation in which the officer is making an escape from the responsibility. Many often the longevity of probation officers is treated as reason for stress and/or burnout and they â€Å"are more likely to leave the position or try to avoid additional work.† (Peak, 2001). Conversely, the recommendation of the officer is not based on any such reasons. It is a correct recommendation to make considering the given facts. It is particularly notable that the recommendation and the decision with regard to the specific case must be followed through and if any type of

The member of the wedding Essay Example | Topics and Well Written Essays - 1750 words

The member of the wedding - Essay Example Jasmine and proceeds to try grown up things, like going to a bar and drinking, making a date with a much older military man, and dresses nicely with perfume. It is noticeable that both of these personas – Frankie and F. Jasmine – have the same obsession, which is to leave the town. In the end, Frankie seems to settle into her own identity of who she is in that moment, which is neither a boy, a woman, nor an adult, but is, in fact, an adolescent girl and it is only then that Frankie stops obsessing about leaving the town and settles into the normal life of schoolwork and hanging out with a best friend. Frankie Addams, while ostensibly a tomboy is also confused, as she is perched on the boundaries of childhood and adulthood, as well as straddling the lines between masculinity and femininity, while being subjected to sexuality that is presumably beyond her tender years. The masculine/feminine dichotomy is shown by the fact that Frankie has a boy’s name, and is, by all accounts, a tomboy, yet also puts on Sweet Serenade perfume (White, 1985, p. 89). In one scene, Frankie is cussing like a man, and threatening to shoot every person who said that she â€Å"smelled bad† with a pistol, then John Henry repeats that Frankie smelled like â€Å"a hundred flowers† because of her perfume (McCullers, 1946, pp. 610-611). The feminine side is further shown when Frankie dreams about changing her name to F. Jasmine Addams (McCullers, 1946, p. 616), although this name is still a blend of the masculine and feminine. The Jasmine part is definitively feminine. Yet calling herself à ¢â‚¬Å"F. Jasmine Addams† denotes a certain sound of masculinity. According to Groba (1994), in quoting Simon de Beauvoir, this is to be expected when young girls who rebel against society and refuses to accept the roles that others have thrust upon her, yet does not have the courage to completely repudiate the roles. This leads the young girl to either take flight from reality, as

The Secret Life of Walter Mitty Essay Example for Free

The Secret Life of Walter Mitty Essay The two short stories I am going to be comparing are The Secret Life of Walter Mitty and Young Goodman Brown. At first, these two stories might seem very different but they many similar themes. Both stories have the main character hallucinating about different situations. In The Secret Life of Walter Mitty, Walter Mitty wishes to hallucinate to escape reality and be part of an unreal world. In Young Goodman Brown, Goodman Brown, the main character was forced into seeing something not though of as being real by a stranger he met in the middle of the woods. Another similarity between both stories was that the main characters in both the stories had spouses who affected them throughout their lives. The most important reason that I will be comparing both these stories is because they both follow a general plot, leaving the main character very unhappy at the end. In Young Goodman Brown, Goodman Brown leaves his wife and heads for the village. There, he meets a devil figure and they both continue the journey. Goodman Brown does get a feeling of turning around and heading back home, but keeps going after seeing some of his townspeople in the woods. After getting to a secluded spot, he sees that most of the townspeople are also going to a meeting to crossover to the evil side. Goodman then sees his wife among the crowd and screams her name out and tries to tell her to look towards heaven and resist the evil. As he screams that statement to his wife, Faith, everything around him goes away and hes in the forest all by himself. He wonders if what happened was a dream or a reality. He thinks that what he saw was not a dream and lives his life from that point onwards thinking it was real. Walter Mitty hallucinates in a different way in The Secret Life of Walter Mitty. Having a dominating wife who never lets him as he pleases, he escapes his existing life daydreaming about adventures. If daydreaming were an illness, his would be diagnosed as life threatening. It was so serious that if he were to pass a hospital, he would start imagining being a very famous surgeon practicing an extremely complicated procedure. His unrealistic experiences ranged from being a commanding officer on a ship in bad weather, to a famous trial lawyer, as well as a courageous member in the armed forces. In the time range of dropping his wife to the hairdresser to meeting up with her when she was done, he had gone through four different illusions. The hallucinations between both the characters are very different. Walter Mitty knows that what he experiences are daydreams and never real, but he is not bothered because he is very content with escaping his current life. He also has short dreams which most of the time never make it to a conclusion. On the other hand, Goodman Brown didnt even know if what he had experienced in the forest was real or a bad dream. However, being so confused, he took it as not being a dream and went on with his life. Logically speaking, it was most likely a dream, and the length of his dream was a lot longer that Walters. He also didnt enjoy the pleasure of that kind of a dream, because he felt very uncomfortable when he realized that he was in the forest by himself after what he had witnessed. He also was not able to finish his hallucination completely, leaving it up to question if Faith, his wife ever did cross and join the evil.

Celie :: essays research papers

Celie   Ã‚  Ã‚  Ã‚  Ã‚  In section three of The Color Purple, the main character is Celie. In this section she gains a little more control over her life, begins to express herself through creativity and also becomes more free and independent. Her decision to leave with Shug to go to Tennessee and begin her own pants business is good examples of these things. This section shows how much progress she has made in herself. We learn about Celie through different situations and dialogues she has throughout this section.   Ã‚  Ã‚  Ã‚  Ã‚  On page 183, Celie decides to leave with Shug Avery to go back to her home in Tennessee. Previously in one of the lost letters from her sister Nettie in Africa, she read that her Pa wasn’t really her Pa at all. All of a sudden her world is shook when she discovers the real truth about her parents. â€Å"My daddy lynch. My momma crazy. All my little half brothers and sisters no kin to me. My children not my sister or brother. Pa ain’t Pa (Walker 183).† She realizes that everything she was told since she was a child was a lie and decides to just get away from it all with Shug. No one was there to hold her back. In leaving, she is gaining more control of her life. She is moving on to do better things for herself for once in her life.   Ã‚  Ã‚  Ã‚  Ã‚  Also in this section, Celie begins her own pants business. Making these pants is more than just simply constructing pieces of fabric together for her. For Celie it’s a new road to her own freedom and independence. We learn through her that she has a creative flair and is actually quite good at making theses pants. She uses her creative abilities to make a living. We see that she begins to that she begins to feel that she has more of a purpose. She isn’t so dependent on Shug as she used to be and learns to depend more on herself. Shug says to Celie at the end of this section, â€Å"You making your living. Celie, she say, Girl, you on your way (Walker 221).† We can obviously see that she definitely is on her way to being more self-reliant and independent.

A Nation of Wimps Essay

A Nation Of Wimps Parents are going to extreme lengths to take the bumps out of life for their children. However, that has the net effect of making kids more fragile, and that may be why they’re braking down so easily. People learn through experience, and through failure they learn how to cope with things later on in life, themselves. And whether we realize that or not, this nation is turning out to be producing more and more wimps. The Fragility Factor College is one of the biggest fragility factors. It leads to psychological distress, binge drinking, substance abuse, self-mutilation, etc. Relationship problems don’t go away, anorexia and bulimia keep on coming. Welcome to the Hothouse Parents are overprotecting their children, they are intruding too much into their lives. They started to call colleges and asking about their grades. American parents today expect their children to be perfect, and that puts to much pressure on them. Arrivederci, Playtime Children don’t play enough these days. Over 40, 000 schools in the U. S. don’t have recess anymore. Commercialization of children’s play leads to more stressed out children. Plays develops cognitive thinking, and is important for normal development of children. The Eternal Umbilicus Cellphones today make children addictive to their parents. Students are typically in contact with their parents several times a day, which makes them constantly homesick, and keeps them away from learning how to manage for themselves. All that is the pathway to depression, it weakens self-regulation, it influences relationships and friendships, and make children become more frustrated and impatient which then leads to the fail of relationships and even greater depression. From Scrutiny to Anxiety†¦ and Beyond What creates anxious children is parents hovering and protecting them from stressful experiences. This group of children experiences stress in situations most kids find unthreatening. They grow up shrinking from social contact, and lack confidence. They are later on easily influenced by others. Overparenting creates lifelong vulnerability to anxiety and depression. Endless Adolescence Adulthood no longer begins after adolescence ends. Kids are starting to extend childhood, because they are making up for the things they weren’t supposed to do as children, and are creating a whole new stage called the â€Å"early adulthood. † Boom Boom Boomerang Play is connected to the making of healthy relationships later on in life. The less time children spend in play, the less socially competent they become. Through play we learn how to read feelings and negotiate conflicts. Taking the play out of childhood is bound to create development lags. Just Whose Shark Tank Is It Anyway? Competition has become a stressful and significant part of our everyday lives. Parents imagine that their children must be swimming in a big shark tank. Kids today are more ambivalent about the college race than are parents. Nowadays, parents are actually locking their kids into fragility, and by that the kids never learn how to cope with anxiety. Putting Worry in its Place Parents need to abandon the idea of perfection and give up some the invasive control. Children are far less integrated into adult society than they used to be, and by that parents have introduced a tendency to assume that children can’t manage difficult situations. Parents need to remember that one of the goals of higher educations is developing the capacity of thinking for ourselves. Conclusion Indeed parents today have became overprotective of their children, they overshelter them and overpraise them. They cheat for their children by making up fake diseases and getting them into colleges by relations. All of that is creating a whole different type of kids, that aren’t individuals anymore, we are creating the nation of kinds depending on their parents, a nation of wimps,

Business Law. Specific Performance Essay

Business Law: Unit 6 Assignment 1 Specific Performance In the realm of contract law there are many ways of addressing breach of contract. The purpose of this paper is to analyze four separate scenarios and decide if the remedy of specific performance would be applicable to any of them. Specific performance is, â€Å"An extraordinary equitable remedy that compels a party to execute a contract according to the precise terms agreed upon or to execute it substantially so that, under the circumstances, justice will be done between the parties.† (retrieved September 7, 2013, from http://legal-dictionary.thefreedictionary.com/Specific+performance) Or, to put it succinctly, the court will order the contract to be fulfilled as written, with no damages awarded. Generally, however, two circumstances must apply before specific performance will be granted; monetary damages must be inadequate to the situation and the subject matter of the contract must be unique. (source, Fundamentals of Business Law: Summarized Cases, Miller and Jentz, 2010, c h 12, pg 246) Scenario A Tarrington contracts to sell her house and lot to Rainier. Then, on finding another buyer willing to pay a higher purchase price, she refuses to deed the property to Rainier. Land is always a unique subject. It has a specific location and properties that even a parcel directly adjacent might not have. And the house that sits on the land may differ substantially from those around it. For example, one parcel of land may be relatively flat and good for commercial development, but the property right next to it may be very hilly and rocky, making development more difficult. For these and other reasons a buyer simply cannot go out and find an exact replacement. In our scenario Tarrington has breached her contract with Ranier and Ranier can rightly ask a court to grant the remedy of specific performance and order Tarrington to fulfill the contract. That is unless she actually sold the land to the other buyer. In that case, Ranier would have to pursue damages as remedy. Scenario B Marita contracts to sing and dance in Horace’s nightclub for one month, beginning June 1. She then refuses to perform. This case is not one that meshes well with specific performance. This is simply because it deals with a contract for personal service. The text of the thirteenth amendment to the Constitution of the United States says, â€Å"Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction. (emphasis added)† (retrieved August 7, 2013, from http://www.law.cornell.edu/constitution/amendmentxiii) Marita’s contract is for her to sing and dance and while her performance might be unique, it is a personal service and if a court were to force her to perform that would certainly be involuntary servitude. However, she is in breach and Horace would still be able to sue her for monetary damages. Scenario C Juan contracts to purchase a rare coin from Edmund, who is breaking up his coin collection. At the last minute, Edmund decides to keep his coin collection intact and refuses to deliver the coin to Juan. Rare coins are by definition unique. In fact their value is wholly derived upon their rarity. Also monetary damages would be completely inadequate – while coins, like art may have value as investments, collectors often pursue ownership of such items for aesthetic reasons and not just economic ones. While we are light on specifics in the scenario, as a general situation I believe specific performance is warranted here. There may be a situation where it would not be, I suppose. Perhaps if another coin was readily available and Edmund pointed that out to Juan, conflict could be avoided and then I doubt Juan would be able to make an argument for damages. Scenario D Astro Computer Corp. has three shareholders. Among them are Coase, who owns 48%, and Cary, who owns 4%. Cary contracts to sell his 4% to DeValle but later refuses to transfer the shares to him. Ordinarily I don’t believe that shares of stock would fall under the specific performance remedy. But in this case we’re dealing with a slightly different situation. The fact that there are only three shareholders means that Astro Computer Corp. is a closely held corporation. A closely held corporation is, â€Å"Any company that has only a limited number of shareholders. Closely held corporation stock is publicly traded on occasion, but not on a regular basis. (emphasis added)† (retrieved August 7, 2013, from http://www.investopedia.com/terms/c/closely-held-corporation.asp) This means that even though the stock is not as controlled as totally privately owned company would be, it’s shares are not traded on a daily basis like companies such as Apple or AT&T. So it follows, then, that Astro Computer stock is a unique item that simply can’t be replaced by simply going to the local stockbroker. Additionally, those shares of Cary’s would give Coase a controlling interest in the company and that makes them even more unique and renders a monetary solution inadequate. Therefore, I believe that Coase has a very good case for a specific performance remedy. In each of these scenarios we find subtlety of law, logic and, hopefully, justice. They also point out very good reasons to ponder well before entering into a contract, as you may find that regardless of what you eventually want, your signature on that contract could mean you must fulfill the terms even if you would be willing to pay money to get out of it.

Complete Guide on How to Craft a Winning Geography Term Paper

Complete Guide on How to Craft a Winning Geography Term Paper The Peculiarities of the Geography Term Paper The Geography term paper is a written assignment that should be written by those students who attend particular courses, such as Ecology, Oceanography, Geomechanics, Earth sciences, and Geology. Students may be required to complete the Geography term paper at the end of one of the courses mentioned earlier. Usually, a term paper is based on in-depth research, and therefore, it has many features in common with a research paper. Similar to the structure of the research paper, this type of paper should contain several pages since you have to describe the selected topic in detail. In order to receive a high mark for your Geography term paper, you have to conduct your own research, apply different statistics, charts, and other people’s research, as well as structure your paper in accordance with all professors requirements. What is more, you may extend one of your previous research papers or utilize the information mentioned there for your term paper. Thus, writing a Geography term paper is not an easy task since it requires you to conduct in-depth research and analyze various sources. The Geography term paper should contain personal thoughts, critical analysis, and factual information. Therefore, you should include your own ideas about the selected subject and propose new solutions to the chosen issue. What is more, Geography is closely connected with other fields, such as Geology, Ecology, and Earth Science, which is why you may conduct a precise investigation through the prism of those fields. Hence, you can apply knowledge of different disciplines to make your Geography term paper more detailed and thorough. Find a Perfect Topic for the Geography Term Paper Usually, the professor provides students with a list of acceptable topics for the term papers. Sometimes you may be required to create a topic for your term paper on your own. In this case, you will be able to select a topic of your interest. You should remember that the topic of your term paper should be part of the course. Thus, you shouldn’t choose a completely new topic. Plus, you have to select a relevant issue for the paper because it will be easier for you to find some credible sources. It can be explained by the fact that if you select a recent event for the analysis, you will be able to present your vision of the situation or propose your solution to the issue. Furthermore, you have to choose a topic carefully since it is the first thing that the readers see. It should attract the reader’s attention and present what you want to describe. Besides, you should always bear in mind that your topic should not contain more than fifty-one characters. As you can see, many aspects should be taken into consideration while creating a topic for the Geography term paper. The following list of topics is acceptable for your Geography term papers: The Influence of Deforestation on the Arid Area; How Volcanic Eruption Affects the Ozone Layer? The Possible Solutions to the Hazard of Landslide; Geomorphological Changes in Central Europe; The Influence of Modern Ways of Farming on Soils; The Consequences of Floods in South America. Browse Appropriate Sources for the Geography Term Paper Before you start writing the term paper, recognize the central points of the selected topic. To do it, you should investigate the topic either in the library or on the Internet. If you decide to use the Internet, you should always remember that not all websites contain reliable information. You have to omit using the websites that end in .com and .net. There are many other online sources that may help you with writing the Geography term paper. You should consider the websites that are maintained by the government or educational institutions since they are supposed to be credible enough to utilize them in academic writings. Apart from that, there are many other websites that don’t end in .gov or .edu, but they’re still credible. What is more, you can apply various types of sources in your term paper, such as interviews, speeches, textbooks, maps, and even encyclopedias. The following geographic online sources may be useful for you while writing the Geography term paper: The World Factbook (an online source that contains different information on diverse countries of the world. The articles are written by professionals in Geography and closely related fields, and describe different disciplines, such as the Economy, Geography, and Social Environment); The Sage Handbook of Qualitative Geography (the database of articles divided into three sections, namely encounters and collaborations, openings, and making sense); GeoRef (an online database that identifies various books, articles, and other publications that relate to Geology and Earth Sciences); Web of Science (an online multidisciplinary database that identifies journal articles in all social science disciplines, including Geography). The Importance of the Prewriting Activity Once you have understood the key aspects of the selected topic and found necessary information, proceed to the pre-writing activities. With the help of these activities, you will be able to gather interesting ideas and create an outline. There are plenty of pre-writing techniques, but only the most effective ones are going to be presented. Techniques for More Effective Brainstorming. This technique is perfect for teamwork, but it can also be applied when you write the paper on your own. The central idea of this technique is to write as many ideas as possible quickly. You may use bullet points or make a list in order not to waste time organizing the complete sentences. For example, if you decide to investigate the factors that cause a volcanic eruption, you may think about the countries with the largest number of volcanoes and compare what features they have in common. As it can be noticed, this type of pre-writing technique requires you to have additional knowledge of some other fields. Freewriting to Get Yourself Out of a Creative Rut. This pre-writing exercise is similar to the previous one since you should generate ideas non-stop. There is one essential difference – you have to write complete sentences. At the same time, you should not think too much about grammar and spelling since the primary goal of this technique is to create the first draft of your term paper. This type of pre-writing exercise is not for everybody because it requires strong writing skills. However, if you can handle the previous pre-writing technique, you may try to complete this one since you will have the central ideas for the paper. Apply Mind Mapping Techniques. This particular pre-writing technique requires you to focus on the central ideas and expand them. For this exercise, you have to put the primary ideas in circles and draw some lines to write some supportive ideas or connect some other related ideas. Therefore, if you want to compare the geographic features of two different areas, you should divide the paper into two parts and draw two circles on each part. Those two circles will represent common and different features. This technique is a great option for visual people since it allows to visualize the ideas in one’s head easily. With the help of the techniques mentioned before, you will be able to create an outline for your term paper since you will have all the necessary ideas for all paragraphs. The Structure of the Geography Term Paper Now you’ve reached the point when you should develop the ideas collected during the pre-writing activities into a good structure for your term paper. All academic writings have a similar structure. It means that all of them have an introductory section, the main body segment, and the conclusion. Besides, each of those parts has its special structure which will be described below. Let’s take the influence of deforestation on the arid area as a sample topic to see how the approximate structure of the Geography term paper should look like. Introduction Where the Story Opens Up This part of the term paper should not be too long since it should briefly present the issue that you want to describe. Furthermore, you are not allowed to insert any in-text citations and quotations. The introduction should contain background information, some key ideas, which will be expanded in the main body paragraphs, and a thesis statement, which will be explained and supported there as well. The following thesis statement may be acceptable for the selected topic â€Å"The Influence of Deforestation on the Arid Area†: â€Å"In the particular arid areas, such as Africa, Central America, some parts of South America, and Australia, intensive deforestation induced the starvation of a significant number of people and animals since most of the local rivers and lakes had dried.† Main Body: a Place for Specific Evidence Supporting Details In this section, you should write more than two paragraphs since you should have more than two arguments that will support your thesis statement. Unlike the introductory paragraph, here you can apply various in-text citations and quotations and properly cite them to make your paper free of plagiarism. There are two major referencing styles, namely APA and MLA. For the APA referencing style, you have to mention the author/author’s last name and the year of publication. For the MLA referencing style, you don’t have to provide the year of publication. Instead, insert the number of the page where you found the information. To make your term paper smooth, you should apply different linking words. As you may notice, there are plenty of details to take into consideration while writing the main body paragraphs. Conclusion: Shape the Impression that Stays with Your Readers! The concluding part of the term paper is quite similar to the introductory one since both of them should be of the same size and free from in-text citations or quotations. In this paragraph, you have to restate the thesis statement and support it with arguments mentioned in the main body paragraphs. You are not allowed to write the information that was not mentioned in the previous paragraphs. In general, the conclusion should look like a shortened version of the entire term paper. Proofreading to Get Your Paper to Absolute Perfection Having finished writing the term paper, you have to re-read it to ensure that you have not made any grammar, spelling, or stylistic mistake. Pay special attention to the punctuation and word choice since you may forget to put a comma after a linking word and before the â€Å"and† when listing elements. Furthermore, you should always remember that you have to use a particular vocabulary while writing academic papers. Besides, it is advisable to re-read the paper the next day because then you will be able to look at the text from a fresh perspective. Apart from that, you can ask another person to check your term paper. However, you should select the person who has strong writing skills and will be able to detect and explain the mistakes. Ask that person to tell you whether the paper is coherent and cohesive. If it is not, ask what part of the paper should be changed to improve its quality. As a result, if you follow most of the recommendations presented above, your professor will be satisfied, and the term paper will receive a high mark. 6 Fabulous Hints to Become a Successful Writing Major

6 Fabulous Hints to Become a Successful Writing Major 6 Fabulous Hints to Become a Successful Writing Major There are several skills one must improve to be a truly great writer. Here we are going to name six key skills for excellent writing, as well as tips on how to acquire and improve these traits. 1. Knowledge of Grammar, Spelling, and Punctuation You can have creative ideas and excellent writing abilities, but without proper spelling, grammar, and punctuation, you cannot communicate your ideas effectively. People do not want to read writings that are full of errors, and you lose credibility when you cannot spell or punctuate properly. The best way to improve your language is to read. Read books, newspapers, favorite blogs - read anything. The more you read, the more spelling and grammar become second nature to you. Another way to improve your grammar is to search the Internet any time you are uncertain about how to punctuate a sentence or which verb tense to use. There are many excellent grammar websites devoted to consult you. 2. Understanding Your Purpose There are different types of writing for different purposes: narrative, persuasive, literary analysis, etc. To write effectively, first you must understand the purpose of the paper you are dealing with. Are you analyzing literature? Are you telling an entertaining story? Are you persuading the reader to agree with your opinion? When you are writing a college paper, look through the restrictions carefully. If your professor provides you with the demands, read them a couple of times to make sure you have fully understood your task. If you thoroughly understand the purpose of each piece you handle, you will be on your way to a writing master’s degree! 3. Imagination Excellent writers have perfect imagination. It is a skill you cannot be taught of, but you can develop it. Go to different places, observe people, try something new. Write down your observations in a notebook. If you have a dream, you can record it in your journal as well. Open your imagination even further by reading novels that take place in fantasy lands, or by watching movies that explore unique topics. Imagination comes from exploration and experience, so cultivate your imagination by being open to different places, people, and adventures. 4. Discipline A guaranteed way to improve any skill is to practice, so the best way to become a better writer is to write. Even if you are not in the vein to do this, or you feel like you have a writer’s block, simply take the pen or start typing. Write something every day, even if it is a short entry about what you have experienced and thought that day. The more you write, the more you will improve. You even won’t notice how you have became a writing MFA. 5. Research Skills When it comes to academic writing, being a good researcher is a must. Who is a good researcher? Someone who can find convincing, valid evidence to support the claim in his/her writing. One way to improve your research skills is to evaluate the sources you have chosen. While choosing a source to use in your paper, ask yourself the following questions: Was this source recently updated, or it is outdated? Who wrote this information? Would this person or organization be involved to this topic? Is it a trustworthy source with credible information? Is this information relevant to my topic? Make sure you are getting your research from the sources that are credible, current and relevant. The most important item for an excellent research is to know which sources to use. You also should be able to synthesize researches from several different sources, instead of using only one and simply paraphrasing its information. 6. Ability to Take Constructive Criticism We are our own biggest critics, so we must criticize our writings. Take yourself through multiple drafts instead of deciding that the very first one you have written is the best. Focus on your spelling, grammar, word choice, and organization. Do you stay on topic? Do you use strong vocabulary? Moreover, you can ask others for feedback, and do not take their criticism personally. The only way to get better is to continue learning and improving your writing skills. No writer is perfect, so continue striving for constant improvement. If you follow these tips, you will be amazed how much your writing skills have improved!

Property law Case Study Example | Topics and Well Written Essays - 750 words - 4

Property law - Case Study Example The general legitimacy of franchising allows the franchisee to organize the business in any of the appropriate options; a sole proprietor, corporation or a partnership. This is not a good option however, because the franchisor dictates the business model to the franchisee. This means, that the business that Betty wants may not give the impression of a Christian coffee house at the end. Again, Betty will have to pay loyally fees, an idea that is not good for a business of her kind. Franchising is therefore not an option both in legal basis and Christian basis as there will be many foreign dictatorial powers. On the other hand, this discussion agrees that Betty will gain the operational expertise should she opt to use this option. This is because franchising will attract a host of qualified investors to her limited liabilities, but will many foreign non-Christian behaviors and ideologies (Ibrahim and Angelidis, 2005). Secondly, concerning the option of sole proprietorship, it is import ant to note that this is the easiest option for Betty to start a coffee house. It is true that this option requires very little legal issues to look at. Betty will have the full control over her business idea. In business terms, this option has high risks associated with it. On the contrary, this discussion does not agree that welcoming many customers brings risk, but rather these customers are the source of income e and advertisement at the same time; it will be an opportunity to instill Christian values in the customers. However, it agreed that this option limits Betty`s abilities to expand the business through increase of capital. Thus, it is recommended that this is not a good option to consider for starting a coffee house. Thirdly, the best choice is that of a corporation; this allows investors as well as partners to take part in the business. Studies have shown that, legally, a corporation is a legitimate entity that allows a group of people to exist and act as a single legal person. This allows them to raise funds through shares. This discussion agrees that, a limited liability corporation suits the business idea for Betty (Ibrahim and Angelidis, 2005). This is because it gives owners corporate protection. This option will allow the Betty and her partners to come up with the details of management and operating agreements, legal application for the approval of the corporate name, and the creation of then article of incorporation. This serves the purpose as an option for Betty to take because it ha many advantages and it limit risks as they are shared among partners and investors. Other partners and investors To start with, Betty`s husband, John is a good partner as he offers the right financial support. The discussion agrees that Betty and John do not need to handle separate roles in the business or one should not be dormant because as man wife they are one and this is a family investment. Thus, Betty and john can seek for shares in the limited liability corporation and provide services in the end as an exchange for the shares. It is therefore recommended that they should work together to achieve and realize the goals of the business; they can be guarantors for a loan to their corporation. In addition, because this is a Christian coffee house, it entails to sustain the Christian values, thus the discussion agrees that Betty and her sister, Alice should be careful not to do things

Mobile computing and wireless communications for construction projects Literature review

Mobile computing and wireless communications for construction projects - Literature review Example At present, the majority of construction businesses necessitate flexibility for their staff about place and time. In this scenario, information and communication technology (ICT) and its products (such as mobile and wireless computing) offer the independence of mobility to members in the construction market and business. Additionally, the wireless connectivity and mobile technologies can be implemented in construction sites in an attempt to ensure real-time data transferred all through the business tasks (Garza & Howitt, 1998; Koseoglu & Nielsen, 2005). In addition, it is believed that the acceptance and implementation of modern technologies such as mobile and wireless computing inside the construction sector is not up to scratch, in particular when related to the considerable research endeavor and outlay taking place inside this sector. On the other hand, there are several instances of wireless computing, and yet location aware computing that have been implemented effectively within the construction sector and shown fruitful results. Moreover, these instances have demonstrated how successful implementations of mobile and Wireless Computing have received greater user acceptance and shown an amazing return on investment within one year of implementation (May et al., 2005). Furthermore, the mobile and wireless computing has gained popularity in the past few years. ... This paper presents the preliminary findings from a literature review focusing on the usage of mobile computing and wireless communications for construction projects. This paper will discuss different aspects of mobile and wireless technology, their advantages and disadvantages for the construction projects. Evolution of Mobile Computing Before we proceed towards the discussion on the use of mobile computing for construction projects, we must understand the theories and concepts related to mobile computing. Historically, the developments in the computer networking during mid-1970s have offered a great deal of support for the potential development of mobile computing technology. This technology has offered a reality of distributed computing that provides the capabilities for numerous computers and clients to communicate and share remote data and information resources over a network. It has also given birth to a lot of other related fields such as distributed computing, comprising dist ant collaboration and communication, high accessibility, fault tolerance, communication security, remote information access. In addition, with the emergence of high-tech laptop computers, the wireless networks and the incorporation of cellular technology with the Web, required the researchers to design new network technology based distributed systems for mobile clients. Additionally, the mobile computing that relates a lot of fundamental standards of distributed system design, and that as well expands this hypothesis to convene mobile users’ needs, offers a fundamental arrangement in which clients are able to access the similar point in the

Soil and Microbes Essay Example | Topics and Well Written Essays - 1250 words

Soil and Microbes - Essay Example Soil and Microbes Due care should be taken while handling the soil samples collected from different locations. Preliminary examination of the soil samples can be carried out by wetting the soil sample with water and squeezing them between the fingers to ascertain the type of soil, if the soil is sandy it falls apart, silty soil gives a flour type feeling and if the soil has clay then it holds together. Soil samples may contain microorganisms such as Bacteria, Fungi, Algae, Actinomycetes and Viruses. All the microorganisms may either exist singly or in colonies. There are various techniques to detect form, pattern and arrangement of microorganisms in soil such as Microscopic methods and Microscopic methods plus culturing. Microscopic methods involve examination of soil samples under a light microscope by using simple stains such as phenol aniline blue and fluorescent stains such as fluorescein isothiocyanate (FITC), acridine orange, rhodamine (fluoresces red), europium chelate (europium (iii) thenoyltrifluoroacetonate), DAPI (4'-6'-diamidino-2-phenyl-indole), ethidium bromide and Hoechst 33258 (bisbenzimide). While the first method can be adopted with any bright field white light microscope assuming that light can be transmitted through the object under examination but in the second method, the stain emits light at a visible wavelength on illumination with ultraviolet light. In microscopic methods plus culturing the soil samples are impregnated with agar or polyacrylate resins and sectioned into thin plates and examined by direct microscopy. One more method called the fluorescent antibody technique is the only technique that can locate and identify microorganisms simultaneously in intact soil samples or sections. In this technique the antibodies to microbial cells are generated by injecting the cells under study into a suitable animal (guinea pigs or rabbits) which produce antibodies to the microbial cells that can be isolated from the serum samples of the animals. The antibodies are proteins that can be reacted with FITC to produce FITC-antibody conjugates which will adhere only to the correct microbial cells if applied to a soil sample. Once the excess FITC-antibody conjugate is washed and removed, only those microbial cells will fluoresce, can be located and identified by epifluorescence microscopy. A recent method uses monoclonal or polyclonal antibodies. Certain other methods like Enzyme-linked immunosorbant assays (ELISA assays) and the Polymerase Chain Reaction (PCR) methods can also used to detect the microbes i n soils (Source - United Nations Water Virtual Learning Centre). Isolating bacteria and viruses or virus like particles (VLP) from the soil samples is being investigated through two techniques i.e., Epifluorescence Microscopy [EFM] and Transmission Electron Microscopy [TEM] using two elution buffers (1% potassium citrate and 10Mm Sodium pyrophosphate) (Sampling Natural Viral Communities from Soil for Culture-Independent Analyses by Kurt E. Williamson, K. Eric Wommack and Mark Radosevich). Every possible care should be taken to avoid the microorganisms (Bacteria, Fungi, Algae, Actinomycetes and Viruses) to come into physical contact with the human body or enter into

Changes In Employment Relations Due To Globalisation

Changes In Employment Relations Due To Globalisation Due to globalization the employment relations has affected all over the world. In the past few decades there are many economic policy changes all over the world. Globalization points to combining of countries within the world economy through increased transaction, investment, short term capital flows, and migration of skilled and unskilled workers internationally. This essay describes about changes of employment relations in both advanced and developing countries as a result of globalisation. Globalisation is a process is not a condition or a fact. Globalisation involves two phases. The first phase is about cheap labour for labour intensive production. The second phase is puzzling involves high tech manufacturing and service. Due to global change the employee relations have undergone a sustainable change and the management of human resource have also changed. This paper starts by investigating employment relations in India followed by the employment relations in republic of Korea before and after globalisation. (Lansbury, et., al., 2004) Now this paper describes about India. The population of India was 1.2 billion in 2008.India got its independence in 1947 before the independence the Indian industries was predominate by private owners they used an autocratic leadership style and the employment relations on those days was in an ad hoc manner. After independence the employment relations scenario was totally different because a large number of industrial enterprises was developed this resulted in industrialization. Due to growth in organisation the one main dominance was left behind, the functions of management are distinguished into different departments. Before globalization Indians made their decisions in management based on interpersonal considerations comparative to task demands. This is due to the reason the Indian management institutes have borrowed western education system. (Budhwar, 2003) Indians were brought up in an environment where they value strong family relationship and they are dependent on others. Indian managers in the past are trained in the west and most of the management institutes in India have adopted western management system. Now this essay discusses about trade unions and collective bargaining in India. In India the trade unions have come across four main phases, the four phases are the early years (1850-1900), the growth years (1900-1947), the militancy phase (1947-1970) and decline phase (1980). (Budhwar, 2003) The trade unions were strong before 1980 after 1980 the trade unions began to weaken. The reasons for failure of unions are the workers to lose faith due to more strikes and they lost the confidence in military trade unionism. In India most of the trade unions in the past are controlled by outsiders like political parties and other persons who were not working in the industry. The collective bargaining in India has come across three periods from 1920 to 1950 and 1951 to 1969 and from 1970 till now. From 1920 to 1950 the collective bargaining was in the early stage and this method was not used for the regulatory labour conditions. In 1951 to 1969 collective bargaining was used to settlement of in dustrial quarrel. When comparing to the developed countries the economic condition in India was less due to this the union workers could not be in strike for a long time. (Budhwar, 2003) Discussing about the employee relations in the state Indian government has proposed four policys over the past like maintain industrial peace and foster trade unions peace. To achieve the policy state has come up with many labour laws but the laws were not successfully implemented. Before the new economic policies the state government encouraged unions instead of cutting down the unions. Due to this reason there were many unions in India. Before globalisation the external trade was 0.44 in 1989 but after the relaxation of economic policies in 1991 the share trade id 0.8 in 2004. But when comparing the trade with china India has grown up less. (Budhwar, 2003) Berore globalization the practise like recruitment, training, promotions and lay off are non generalize. A formal method of recruitment and selection was not followed before globalization. The recruitment was based on word of mouth approach. (Budhwar, 2003) After the liberalisation of Indian economy the law has been proposes that all the new jobs should be advertised properly and process of recruitment should be formal. And also Indian government has created a human resource development ministry at the central government level and there is a large number of professional institutions provide training and development in hr related. The rules as been passed that the new employees should be taken initially as an apprentice this shows that there is a formal and structured approach in recruitment of people in India for organization. (Budhwar, 2003) Globalisation is due to investment of multinational companies in developing countries. According to the World Bank forecast in 2020 India will become as a fourth largest economy in the orbit. After liberalisation of economic policies in 1991 the economy has increased positively. (Jayasuriya, 2008)Due to these developments more foreign firms in advanced countries shows interest of doing business in India. Indian domestic companies are under pressure due to liberalisation and there is an increased level of competition between the domestic firms and MNCs. (Budhwar, 2003) Currently Indian managers are appointing themselves with the new techniques in management and the different phases of the management function which will be helpful in maintaining good employee relation. A research has been conducted in human resource of Indian organisation and they have given a feedback that without the development of human resource, Indian firms will not be qualified to takeover new technology and they cannot competitive with other abroad competitors. (Chishti, 2002) In 1970 new approaches for collective bargaining was developed. From 1970 collective bargaining has moved from enterprise level to the plant level in the country. Due to globalization and increase in multinational companies in India the unions have lost their strengths and reforms. Due to change in economic conditions the unions join with the management now to take a cooperative approach in management decisions. Only two percent of workers in India are under collective bargaining agreements. The collective bargaining is going on shrinking in India. (Chishti, 2002) After liberalised economic policies in India. Many global companies started their plants in India due to globalization the productivity got increased and the employees got higher pay and their basic pay was increased. And the working hours in India is reduced now people in India are working only 48 hours per week. The child labour is reduced in India now people who are above the age of 18 can only work in workplaces. Due to globalisation exploitation of women is more but they are still been paid low. Currently in India there are 150 acts of labour legislation but they are not fully achieved. (Budhwar, 2003) Having discussed about India now this essay discusses about republic of Korea before globalisation and after globalisation. The republic of Korea has a population of 48 million, almost 80 percent of the people are urbanised, and the urbanisation has increased from 30% in 1962 to 80%. The labour force was 22 million in the late 1990 and the participation rate is high and the unemployment rate was not above 2 percent. Korea gross national product has increased due to export oriented manufacturing. Korea is the member of organisation for economic cooperation and development in 1996. In 1997 Korea experienced a financial crisis so it got assistance from international monetary fund. (Bamber, et., al., 2000) In 1945 the liberation was restructured and the left wing ( chun pyung) was banned in 1947 by American military government. The success of Korea industrialisation is due to cheap labour. In 1980 there was a protest by union activist and students against chum doo-hwan government this protest was the turning point of Korean employment relations the government changed is approach from authoritarian to conciliator approach. Before 1987 unionisation was less in Korea due to strong government, after 1987 Koreans unions have grown to be a powerful institution in labour relations. The working conditions of union members are improved by collective bargaining. The collective bargaining was the important tool for the improvement labours. (Bamber, et., al., 2000) There are three levels of Korean unions and they are local unions, an enterprise, and a region. The employees in the work place will be joining in any one of the unions based on their job and Collective bargaining is decentralised in this level. The unionism of Korea has converted, the unions of car companies are affiliated to the Korean trade union congress but they were not officially recognised till 1997. The developments in 1993 are men have removed women in union activity and due to increase in work force of white collar workers, the white collar workers are increasingly unionised. (Lansbury, et., al., 2004) Korean employers are engaged in different employers association. For example the business which is engaged in export or import there is a membership called Korean foreign trade association. So those who are doing export or import should be the member of this association. The chaebol differentiates Korea from other newly industrialised economy. The bank of Korea says that the top 30 chaebol contributes 95 percent of the total nations GDP and the top company which is contributing to the GDP is Hyundai (Bamber, et, al, 2002). The development of internal labour markets is due to agency of chaebol large scale economies for low cost competition. Chaebol was the reason for government growth strategy particularly due to blue collar workers. In Korea they were following one set approach similar workers doing similar work in similar working conditions were concentrated by chaebol in one place or region. By 1945 the government proposed a legislative structure for the Korean industrial relations . So chaebol cut off the action of unions they also sought their amenability as company unions. The Korean employment undergo fundamental changes after 1987, collective bargaining was decentralised with the drift of defending managerial command. (Lansbury, et., al., 2004) The state plays the dominant role in economic growth in industrialization. By 1961 there was a rapid growth in economic role through export led, low cost competition. The state decided the hike strategy of chaebol by range over the business horizontally or vertically. By 1980 the labour laws was rewritten and the unions were alter, and the labour management council act was uttered these acts are passed with the intention making the unions power less and building the labour management linkage non-confrontational. From 1989 to 1993 the wages are increased in Korea for five years where as in 1987 the wages were not given by the government. The wages were given more easily by the public sector then the private sector. (Lansbury, et., al., 2004) The trade union act standardised the collective bargaining in Korea. The members in the union can clear the matters regarding employee and organisation. Mostly collective bargaining takes place at the plant level and collective bargaining is the important factor for regulating industrial relations. The labour management council demanded a labour management council should be created and meet four times in twelve months with a company having 50 or more people working. (Lansbury, et., al., 2004) In 1997 the national assembly of Korea passed an improved set of reformation to the labour legislation which postponed the relaxation of restriction on layoffs. To reduce the labour cost the employers started to employ contract labours. The contractors are responsible for the welfare of the workers. The unions protest against the legislation of dispatch workers but the employers justify that it should be legalised. (Lansbury, et., al., 2004) Due to industrialization there is a decrease in agriculture and unemployment. The agriculture in Korea is reducing by 6% percent every year. Even though there is a massive decline in agriculture the education level is increasing in Korea. The largest business group in Korea hired employees through mass examination but before the economies were developed the workers are hired on the basis of relatives of the employees. (Lansbury, et., al., 2004) There are many migrants in Korea especially from the Asian countries. The migrants are working mostly in the labour intensive work place where the work for labour is more. Due to the crisis of unemployment the working hours in Korea is been reduced, by reducing the working hours more people are employed and benefited. They Korea respond to the critics by adopting new human resource strategies and senior based reward system, increased use of contingent workers and frequent use of lay off. (Lansbury, et., al., 2004) Globalisation is the major factor for the changes around the world, due to changes around the world there are some changes on the employment relations as well. In nutshell this paper as explained about changes in the employment relations in the developed countries as well as the developing countries and it has described about the changes that have gone through in the period of globalisation.

Investigation of Scriptural References Essay -- Religion Bible

Investigation of Scriptural References We find one hundred and ninety times the Hebrew verb rà »m, â€Å"to be high, or to be exalted† in the Old Testament. Basically rà »m represents either the â€Å"state of being on a higher plane,† or the â€Å"movement in an upward direction.† The second emphasis represents what is done to the subject or what it does to itself. Like the stormy wind that lifts up the waves of the sea (Ps. 27:5). God is the Most High, the great king over all the earth and exalted far above all gods (Pss. 47:2; 83:18); 97:9). He alone rules over mankind and grants dominion to whomever he wishes (Dan. 4:17, 25, 32; 5:21). Therefore Israel in response must exalt him above all others as they are his people. It must result that all nations and all creation are called to praise God and exalt him (Ps.148:13). Fanning concludes that all of life is put in its proper perspective only when God is exalted in this way. In the Old Testament â€Å"exaltation† is related to the Kingdo m of God, reflected by God’s chosen people, Israel. We will see later in this point that these reflections have priestly, prophetically and royal tendencies. In the New Testament various Greek verbs are used to express â€Å"exalt†: hupsoÃ… â€Å"to lift up† for the exaltation of Christ by God the Father (Acts 2:33); huperupsoÃ… â€Å"to exalt highly† with reference to Christ (Phil. 2:9); epairÃ… â€Å"to exalt oneself† for being lifted up with pride (2 Cor. 10:5); and huperairÃ… â€Å"to exalt oneself exceedingly† for the exceeding self-exaltation (2 Cor. 12:7). In this regard we note that exaltation is an act of God alone (Luke 1:52). The exaltation causes also a social effect (2 Cor. 11:7) and contains an eschatological element (1 Pet.5:6 and explicit Phil. 2:5). In the New Testament foll... ...0. Matt. 1:20-23. African American Reconstruction Essay

?Reconstruction in the 1800’s can have a lot of different meanings. For some the reconstruction was the rejoining of the two sides that fought in the civil war, the North and the South. For others in government it was the presidential reconstruction after the death of Lincoln. Most importantly for some reconstruction mean finally being a free man with right and who could vote and provide for his family. The African Americans were a big part of reconstruction, just being freed by the passing of the thirteenth amendment which was adopted on December 6, 1865. This new law stated â€Å"Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, nor any place subject to their jurisdiction. † Being freed was a step in the right direction for the African American, but anything not properly followed through with can end up undoing itself. Unfortunately for the African Americans in the south the progress towards freedom and citizenship and equality had hoped for took a terrible turn for the worse and most of their dreams were crushed. The north removing their army from the south to settle a dispute over who would be president undid what the 14th and 15th amendment were set to do and with no enforcement of them and the black codes life for the average African American remained one filled with difficulties and racism. In 1863 the emancipation proclamation was written to give freedom to all slaves in the rebel states, soon following that the Thirteenth amendment was passed. This Thirteenth amendment took the emancipation proclamation one step further and freed the slaves wherever they may be. Now the mass of newly freed African Americans in the South had to face the difficulties of getting a life started while being surrounded by many angry white Southerners. It granted them their freedom, but did nothing to guarantee them with voting rights, benefits, or the same opportunities as their white countrymen. Imagine you spent your whole life surrounded by people who considered you less than a person. To them you were just a mass of living space that only had the brain capacity to do simple jobs. Once you received a certain document, that says you are a full human being with all the capabilities of others, do you think those people would instantly accept this change and consider you an equal in society? When the civil war came to a close, the White Southerners moved quickly to put an end to the African American’s newfound freedom. They wanted a way to return African Americans back to what they were before the war, which were slaves. In order to do this without getting in too much trouble from the north they had to do it in a way that seemed neutral and fair to all races. Anyone with common sense however could tell that these laws were passed specifically to limit African Americans. These laws started out as what were commonly referred to as the black codes. These were a set of laws that were applied specifically to African Americans to help keep them in a form of slavery. Some of these laws were. â€Å"No person of color shall migrate into and reside in this state, unless, within twenty days after his arrival within the same, he shall enter into a bond with two freeholders as sureties†. â€Å"Servants shall not be absent from the premises without the permission of the master†. â€Å"Servants must assist their masters â€Å"in the defense of his own person, family, premises, or property†. â€Å"No person of color could become an artisan, mechanic, or shopkeeper unless he obtained a license from the judge of the district court – a license that could cost $100 or more. † These laws however didn’t stick around forever and then the Jim Crow Laws were put into place. The Jim Crow laws stated that it is okay for African Americans and whites to be separate as long as they were equal. Even the Supreme Court said that Jim Crow Laws were constitutional even though the stuff that the African Americans got was so much less quality. â€Å"For we colored people did not know how to be free and the white people did not know how to have a free colored person about them. † This quote was stated by the name of Houston Hartsfield Holloway following the passing of the thirteenth amendment. Most of these African Americans didn’t know how to be free and adapting to this new life was extremely difficult. These Freeman had to now face the difficult task of not only dealing with the racism of the white southerners living around then but also needed to get jobs. The freedman bureau was then created to try and help newly freed slaves get on their feet. The freedman bureau created March 3, 1865 main focus was to† provide food and medical care, to help the freedmen to resettle, to ensure justice for the freedmen, to manage abandoned or confiscated property, to regulate labor, and to establish schools. † Now that it was legal for these newly freed men to learn, establishing school in which they could learn was very important. These schools would help them learn trades and skills to help them get jobs. While the freedman’s bureau did not establish schools itself, it coordinated and helped to finance the activities of northern societies committed to black education. It is stated in the Voices of Freedom book written by Eric Foner that by the year 1969 only four years after the thirteenth amendment was passed nearly 3000 schools were established in the south. More impressive than that, these schools have more than 150000 pupils. The bureau was able to give former slaves most of the basics like food, shelter, clothing, and a way to make a living. Without being given the basics there is no way the African Americans would ever be able to take care of themselves and support their families. They needed help adapting to the new freedoms they were given, just as white men had to adapt to them being free, (although most of the time white men still treated them like dirt). The passing of the fourteenth and fifteenth amendments helped to make great strides towards equality for African Americans. This amendment was the â€Å"heart† of Congress’ reaction to Johnson’s reconstruction plan and said that all people born in the United States are citizens. This upturned the 1857 Supreme Court decision in Dred Scott v. Sandford. In this case it stated that persons of African descent were not citizens and therefore not entitled to constitutional rights. On top of that it also prohibited states from revoking â€Å"life, liberty or property† without due process of law. Finally it required states to guarantee equal protection under the law. All states were required to ratify it. It was of course to get some of the southern states to ratify a law like this that on top of giving freedom to African Americans would also give them civil rights. Just because the fourteenth amendment said something, which did not mean that it would be enforced. The Military and Reconstruction Act of 1867 however, was passed to make sure that it was. The funny thing about this act is, on the very last day of session for congress, and the congress that was currently fighting with the current president to the point where they tried to kick him out of office overrode his veto and had it passed. The Ten Confederate States that had refused to ratify the Fourteenth Amendment were divided into five military districts. Each military district was put under the direction of a military governor authorized to appoint and remove state officials. Voters were registered, and suffrage was extended to freedmen. State constitutional conventions were called, and elected delegates were charged with drafting new constitutional provisions providing for black suffrage. Finally, states were required to ratify the Fourteenth Amendment before readmission. The congress didn’t stop here however; they later passed even more military reconstruction acts. â€Å"The new acts directed military commanders to register voters, call conventions, and organize elections, rather than wait for state officials to act. In the face of recalcitrance from Johnson’s executive branch and white southerners attempting to subvert the law, Congress in July 1867 passed a third Reconstruction Act, declaring the existing state governments in the South illegal and subject to military control and the U. S. Congress. † In an attempt to delay the creation of new state governments, some southern whites turned to a provision of the first Reconstruction Act requiring that a majority of registered voters was necessary to ratify a new constitution and called for a boycott of the ratifying election. On March 11, 1868, Congress passed a fourth and final Reconstruction Act that allowed a majority of those voting to ratify a new constitution, regardless of the size of the attendance. President Johnson, being the leader of this nation at the time, worked to delay and obstruct the army from enforcing these laws. The main job of the fifteenth amendment was to give the right of vote to any male of any race. Section two of this article also said â€Å"The Congress shall have power to enforce this article by appropriate legislation. † This sounds great at first that the African Americans will not be able to vote with no problems. This, as good as it looked in writing, would ultimately fail in some places due to the terrorist threats that were places upon African Americans who planned on voting. During reconstruction African Americans were brandished political power in the south for the first time. Most of these men were those who either lived in the north or lived abroad, and were educated. Before holding political power most were either lawyers or teachers. Black political power was unfortunately short-lived. Northern politicians grew increasingly conciliatory to the white South, so that by 1872 virtually all leaders of the Confederacy had been pardoned and were again able to vote and hold office. The white men were able to take back the south by putting economic pressure on the blacks and by threatening them. One of the biggest ways in which the blacks were threatened was by the Ku Klux Klan, also known as the KKK. The Ku Klux Klan was originally organized in the winter of 1865-66 in Pulaski, Tennessee as a social club by six Confederate veterans. It started out small and was kept secret at first. When the Klan was first formed they had no violent intentions in mind. After they had a large amount of growth however it turned from a group of people into a terrorist organization. The Klan systematically murdered black politicians and political leaders. It beat, whipped, and murdered thousands, and intimidated tens of thousands of others from voting. The African Americans of course tried to fight back to this injustice at first but because they were outnumbered and had no guns, they didn’t have a chance. â€Å"A 103-year-old woman was whipped, as was a completely paralyzed man. In Georgia, Abraham Colby, an organizer and leader in the black community, was whipped for hours in front of his wife and children. † The KKK’s main objective was white supremacy but President Grant responded to their attacks. In the year 1868 Ulysses S. Grant ran for office and used the slogan â€Å"let us have peace†. After getting the fifteenth amendment passed, the Enforcement Acts were passed, which made it a crime to interfere with registration, voting, office holding, or jury service of blacks. Because of this new law over a 1000 members of the KKK who violated it and interfered were convicted. On top of this act to protect the African Americans there was also the Ku Klux Klan act. These new acts made it so it was okay for the government to interferer and help put a stop against terrorist acts. This act although it did help a little was not greatly enforced. In the year of 1876 was the presidential election of Samuel J. Tilden vs. the Republican Rutherford B. Hayes. In this election Hayes ended up winning the popular vote, but as far as electoral votes went it was a tie. This was a big problem and a hard decision to appease until there was the Compromise of 1877. This Compromise would swing the vote away from the Democrats and to the Republicans in return for the removal of all remaining troops from the south. It was on that day that the period of reconstruction would end and the reconstruction for African American would begin to go backwards in the south. Africans Americans were given a sliver of hope and promised to be free equal man just to have the government not follow up on its promise. With all of the troops now removed from the south there was no one there to help protect them or to enforce the laws in which gave them freedoms and rights. They never did go completely back to the way it was before the civil war, but because of how in those net couple of years segregation and discrimination could have been eliminated it is just as tragic. African American Reconstruction helped lay out a great pathway for African Americans to become truly equal and free men in the United Stated. Unfortunately because of their not being enough support from the government they would get to walk down that path to equality for many years later.

Becoming a scuba instructor

The life of a SCUBA instructor is something that people who have a passion for the water and the beach have imagined as ideal. In fact, it would be the perfect career for most because they think that it would mean spending the rest of one’s life on the beach, languishing under the warm tropical sun and taking a dive in the deep blue cold water. All of these benefits while enjoying a modest salary that allows for enjoyment of the other luxuries in life. For those who become successful as SCUBA instructors, the benefits are even better. One can become a world class instructor who explores old wrecks underneath the ocean and even have their own diving schools. Yet these are all dreams and perceptions of what it is like to be a SCUBA instructor. Not everyone gets a chance to enjoy this life. In fact, it is quite difficult and challenging to become a full fledged SCUBA instructor. In order to become one, there is a series of tests and practical examinations that one needs to undergo. The step after that involves taking additional training to ensure that the licensure is complete. As one SCUBA instructor put it, â€Å"Everyone always imagines a life of relaxation. They always feel as if it is simply swimming once in a while and taking people down for fun dives while getting paid for it. † This is not always the case because it involves a major lifestyle and career change. This also means that there are added responsibilities. The first step in being a SCUBA instructor lies in being able to understand the risks and responsibilities that are involved as well as figuring out the first step that one needs to take to pursue this career. The profession of SCUBA instructor, as previously mentioned, is not an easy one.SCUBA instructor is more of a technical term but the actual role that one plays in most dive operations is one of a dive-master rather than a SCUBA instructor. The main bulk of SCUBA resort operations are taking people down for diving trips.Providing i nstructions to new divers or those who want to improve their skills is only a small part of the entire business. Therefore, for those who want to be SCUBA instructor professionals, training as a dive-master is also necessary. This has been labeled as one of the first disappointments or reality checks that an eager SCUBA instructor has to deal with.It is not so much about teaching students how to dive but also acting as an underwater guide to those who already know how to dive but merely want somebody to lead them and show them around the dive area. This leads to the first aspect that must be considered before pursuing a career as a SCUBA instructor; making sure that if the thought of diving at the same spot in shallow water is something that one will be able to do day in and day out. To ensure that this does not happen, it is usually recommended that SCUBA instructors or applicants find the written job description first and get the proper certification. This leads to higher job satisf action. The reason for this is that it allows for more flexibility with regards to career. Under certain job descriptions, SCUBA instructors may be allowed to handle different classes in different sites depending on the size of the school. The pay grade is much higher, however, depending on the school and the lessons that are taught to the students. Another factor which affects the job pay is the experience that the instructor has which usually means that more experience leads to a better job and hence higher pay. This in return usually leads to a higher rate of job satisfaction. This job satisfaction, however, also requires certain additional qualifications that SCUBA instructors need to comply with. These requirements usually have to deal with the other tasks that a SCUBA instructor may be required to do.For example, most SCUBA instructors are required to have the basic knowledge on how to repair SCUBA gear. This means that the instructor must be proficient with not only one brand o f SCUBA equipment but must also have the knowhow for the other brands. Another requirement that is becoming common among SCUBA instructors is the basic knowledge to pilot a boat. While this is definitely not included in the job description, it is necessary because a number of resort owners would like to save on costs by having one person perform multiple positions. This experience in navigating a boat also carries the additional requirement of nautical licensure and familiarity with the parts of boat from a 15’ skiff to a 48’ cruiser. This also means that while no expertise that is on a specialist level is required a certain level of proficiency with regard to the workings of these basic machines is needed. One of the main draws of being a professional SCUBA instructor is the fact that it allows the individual to live on an island. This is, however, also one of the biggest risks and sources of stress. The reason for this is that living on an island also means that one is isolated from a lot of things in life. From a professional standpoint, this means that when the other duties and requirements, such as those mentioned above, are required, one must be able to deal with those problems with the basic tools. Most dive locations do not have the specialists who can deal with the problem as soon as it happens. These shops are usually located on the main island and need to travel to reach the destination of the dive spot. This means that there is a lag time and any good SCUBA instructor must be able to deal with the events happening immediately. This job hazard is usually very stressful and sometimes even hazardous. The next problem is with regard to the personal life of a SCUBA instructor. Being isolated on dive resorts also means being isolated from members of the family or society. As some studies have shown, prolonged isolation usually leads to certain problems and may lead to greater dangers such as alcoholism which is very dangerous for a SCUBA instruct or. Assignments on dive resorts can last for a span as short as six (6) months and extend to durations as long as six (6) years.Another aspect that a SCUBA instructor must deal with is in regard to interpersonal skills. One must remember that being a SCUBA instructor is not only showing people how to dive but also how one is able to teach. In this line, teaching entails that a person must also be able to communicate to the students just what exactly they must do. The most common problems that even experienced SCUBA instructors need to deal with are the fact that they have to teach people without offending them. Most vacationing divers are largely inexperienced and are not quite adept at even the most basic of diving regulations. In educating these people, it is necessary for the SCUBA instructor to be able to encourage them to learn more without putting them down. This is important because safety practices must always be observed before diving. Other problems with teaching also center on those who have been certified but are only taking their first dive. These are perhaps the most difficult bunch to instruct because they feel that they already know what to do.The self important attitude that most of these certified divers carry is a scary thing because they could always forget the basic safety regulations. As mentioned earlier, in diving, the most important thing is safety because there are a lot of hazards that a diver must deal with during the operation. This is more difficult considering the fact that certain countries have different diving regulations from others and these certified divers may feel that the SCUBA instructor is not an authority. The challenge here, therefore, lies in being able to deal with this people to ensure the safety of the group. Now that these basic requirements and training exercises have been elaborated on, it is also important to discuss the basic steps that one needs to undertake before becoming a SCUBA instructor. The most important step that one needs to take lies in certifying that one is in excellent medical condition. Due to the hazards that divers are exposed to at work, one must be physically fit to endure the rigors of diving. Specific requirements such as a current medical report including blood work, chest X-ray and physical fitness tests are necessary. There is also the matter of valid passport, work permits and of course certification to be a SCUBA instructor. The life of a SCUBA instructor is indeed a very promising one if one is able to carefully study and lay out their plan.As discussed previously, all the considerations such as proper training and expertise are very necessary. Individuals must be prepared for the tasks and responsibilities that the job requires. Aside from this there is also the matter of proper permits and interpersonal skills. One overlooked aspect of being a SCUBA instructor lies in understanding the difference between visiting and island the living on an island because these are two (2) very difficult things. Most people usually feel that living on an island is similar to visiting an island but these are not the same. The reason for this is because people must now deal with the living expenses in relation to the salary that they are provided. Most dive resort owners provide salary based on the cost of living scale of the location. As such, while it may seem that the SCUBA instructor is earning so much more than the locals, the conversion rate when compared to other countries may be much lower than average. This means that while one can live the life of a king on a tropical island, he or she may be a pauper in some other part of the world. To summarize, becoming a SCUBA instructor is not for everyone. While the lure of warm and sunny tropical beaches is definitely alluring, the fact that this is considered a job also means that there is work to be done. It is not all just fun and games. The positive side of this, however, is the fact that it really is much easier to do a job that one loves and enjoys.
